Terms of Service

SmartHR is a business-to-business hiring orchestration platform. It helps organizations manage jobs, candidates, interviews, assessments, offers, and related workflows. Features available to your organization depend on your tenant configuration and integrations enabled by your administrator.

• Workspace access is provisioned by your organization's administrator. You are responsible for safeguarding your credentials.
• You must provide accurate account information and notify your administrator of unauthorized access.
• We may suspend or terminate access for violations of these Terms or to protect the service.

If you use SmartHR on behalf of an organization, you agree that:

• You have authority to bind that organization and to collect and process candidate data for legitimate hiring purposes.
• You will comply with applicable employment, privacy, and anti-discrimination laws.
• You will obtain any required consents from candidates before submitting their personal data to the platform.
• You are responsible for decisions made using platform outputs (including AI-generated rankings or summaries).

Candidates may access limited features via time-bound links sent by email. Links are personal and must not be shared. Candidates agree to follow instructions for assessments and interviews, including proctoring rules where applicable.

You may not:

• Use the service for unlawful, fraudulent, or harassing purposes.
• Upload malware or attempt to disrupt, probe, or reverse engineer the platform.
• Scrape or bulk-export data beyond what your role permits.
• Send spam or unsolicited communications through platform messaging features.
• Misrepresent your identity or impersonate others.

Third-party integrations (including Google Calendar and Google Drive) are subject to those providers' terms. You authorize us to access connected accounts only as needed to deliver enabled features. You may disconnect integrations through your workspace settings.

YutiTech retains all rights in the platform, software, and branding. Your organization retains rights in content it uploads (job descriptions, résumés, templates). You grant us a limited license to host and process that content solely to provide the service.

Hiring data may include confidential information. Users must handle candidate and business information according to their organization's policies and applicable law.

THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE" WITHOUT WARRANTIES OF ANY KIND, WHETHER EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. WE DO NOT GUARANTEE UNINTERRUPTED OR ERROR-FREE OPERATION. AI-GENERATED OUTPUTS ARE ASSISTIVE AND MAY CONTAIN ERRORS; HUMANS SHOULD REVIEW MATERIAL DECISIONS.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, YUTITECH AND ITS AFFILIATES WILL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, OR ANY LOSS OF PROFITS, DATA, OR GOODWILL, ARISING FROM USE OF THE SERVICE. OUR TOTAL LIABILITY FOR ANY CLAIM RELATING TO THE SERVICE IS LIMITED TO THE AMOUNT YOUR ORGANIZATION PAID US FOR THE SERVICE IN THE TWELVE (12) MONTHS BEFORE THE CLAIM, OR ONE HUNDRED US DOLLARS (USD $100) IF NO FEES WERE PAID.

You agree to indemnify and hold harmless YutiTech from claims arising out of your misuse of the service, your violation of these Terms, or your organization's handling of candidate data.

Your organization may stop using the service at any time. We may suspend or terminate access with notice where practicable. Provisions that by nature should survive (liability limits, indemnity, governing law) will survive termination.

These Terms are governed by the laws of India, without regard to conflict-of-law principles. Courts in India shall have exclusive jurisdiction, unless mandatory local consumer protection law provides otherwise.

We may modify these Terms by posting an updated version on https://smarthr.yutitech.in/terms. Material changes will be reflected in the "Last updated" date. Continued use after changes constitutes acceptance.
